1. Definitions
- "Agreement" means these Terms and Conditions together with any enrolment confirmation.
- "Company", "We", "Us", "Our" means Witthaya Code, operating from 248 Nimmanhaemin Road, Suthep, Mueang, Chiang Mai 50200, Thailand.
- "Programme" means any of the learning programmes offered by Witthaya Code, including Python & Data Foundations, Practical Machine Learning, and Production AI Systems.
- "User", "You" means any person accessing the website or enrolled in a programme.
- "Content" means all materials, recordings, exercises, and feedback provided as part of a programme.
- "Portfolio Project" means the final deliverable produced by the learner as part of a programme.
2. Acceptance of Terms
By using our website or enrolling in a programme, you confirm that you have read, understood, and agree to these Terms. You must be at least 18 years of age to enrol. By proceeding, you represent that you have the legal capacity to enter into this Agreement under applicable Thai law.
3. Service Description
Witthaya Code provides online education programmes focused on Python programming, machine learning, and production AI development. Programmes include recorded content, written materials, mentor feedback, code reviews, and a portfolio project. All programmes are delivered online. Availability is subject to cohort schedules communicated at enrolment. We currently deliver programmes in English.
4. Enrolment and Access
- Enrolment is confirmed only after payment is received and a confirmation email is sent.
- You are responsible for maintaining the security of any login credentials provided.
- Programme access is personal and non-transferable. Sharing access with third parties is not permitted.
- We reserve the right to refuse or cancel enrolment if we determine a programme is not a suitable match for your current level.
5. User Responsibilities
- Submit original work. Presenting another person's work as your own is not permitted.
- Engage with mentors and programme materials in good faith.
- Do not share, reproduce, or distribute programme content without written permission.
- Do not use programme resources for commercial purposes without prior agreement.
- Communicate respectfully with mentors and any other participants.
6. Intellectual Property
All programme content — including recordings, exercises, written materials, and feedback templates — remains the intellectual property of Witthaya Code. You are granted a limited, non-exclusive, non-transferable licence to access and use content for personal learning purposes only.
Your Portfolio Project belongs to you. We do not claim ownership over work you produce. We may, with your written consent, reference your project as an example of programme outcomes in our marketing materials.
7. Payment Terms
- Prices are listed in Thai Baht (฿) and are inclusive of any applicable taxes unless otherwise stated.
- Payment methods and any available instalment arrangements are confirmed during the enquiry process.
- Full payment is required before programme access is granted, unless an instalment plan has been agreed in writing.
- Refund policy: If you withdraw before the programme start date, a full refund will be issued. After the programme begins, refunds are considered on a case-by-case basis and are not automatic. Requests should be sent to [email protected] within 14 days of the issue arising.
8. Programme-Specific Terms
- The full scope, schedule, and deliverables for each programme are provided before enrolment. These form part of the Agreement.
- Completion records are issued upon satisfactory completion of all programme requirements, including the Portfolio Project.
- Witthaya Code does not issue formal accredited certificates. Completion records are internal documents confirming participation and project completion.
- If you are unable to complete a module on schedule due to circumstances outside your control, please notify us promptly. We will try to accommodate reasonable adjustments.
9. Disclaimers
Programmes are provided on an "as available" basis. While we take care to ensure content is accurate and up to date, we do not warrant that it is free of errors or that it will meet every learner's specific needs. Outcomes depend on the effort, background, and circumstances of each individual. We make no representations about employment outcomes or salary changes resulting from programme completion.
10. Limitation of Liability
To the fullest extent permitted by Thai law, Witthaya Code's liability for any claim arising from these Terms is limited to the amount paid by you for the programme in question. We are not liable for indirect, consequential, or incidental losses, including loss of income or opportunity. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by our negligence.
11. Indemnification
You agree to indemnify and hold harmless Witthaya Code, its team members, and contractors from any claims, losses, or damages arising from your breach of these Terms, your misuse of programme content, or any infringement of third-party rights resulting from your actions.
12. Termination
We may suspend or terminate your access to a programme without refund if you breach these Terms in a material way and fail to remedy the breach within 7 days of written notice. You may withdraw from a programme at any time, subject to the refund policy in Section 7. On termination, your access to programme content will cease. Sections 6, 10, 11, 13, and 14 survive termination.
13. Dispute Resolution
In the event of a dispute, we ask that you contact us at [email protected] first, so that we can attempt to resolve the matter informally within 30 days. If informal resolution is not possible, disputes will be subject to the exclusive jurisdiction of the courts of Chiang Mai, Thailand. These Terms are governed by the laws of Thailand.
14. General Provisions
- Entire agreement: These Terms constitute the entire agreement between you and Witthaya Code in relation to programme use.
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions continue in full force.
- Waiver: Failure to enforce any provision does not constitute a waiver of future enforcement.
- Assignment: You may not assign your rights under these Terms without our prior written consent.
- Notices: Formal notices should be sent to [email protected].
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by email to enrolled learners at least 14 days before they take effect. The current version of these Terms is always available at witthaya.live/terms-conditions.html. Continued use of our services after changes take effect constitutes acceptance.
